Mandatory Window Inspection Scheme · MWIS

Received a Window Inspection Notice? Understand the Deadlines

The following information is compiled from public documents issued by the Buildings Department, the Housing Bureau's Independent Checking Unit and the Legislative Council to help owners and owners' corporations understand the requirements.

What Is the Mandatory Window Inspection Scheme?

MWIS and the Mandatory Building Inspection Scheme were fully implemented on 30 June 2012 to address building disrepair and the risk of falling windows. Owners of private buildings aged ten years or more, excluding domestic buildings not exceeding three storeys, who receive statutory notices must appoint a Qualified Person to carry out prescribed inspection of all windows and supervise any prescribed repair considered necessary afterwards.

An owner's legal obligation arises after service of the statutory notice. The Buildings Department usually sends owners or owners' corporations a pre-notification letter before issuing the statutory notice, generally one to two months later, to allow preparation.

Window Inspection Deadlines

MWIS statutory deadlines, counted from the date of the statutory notice
SituationAppointment of a Qualified PersonCompletion of Prescribed Inspection & Repair
Windows in Individual UnitsWithin 3 monthsWithin 6 months
Common-part windows, with or without an owners' corporationWithin 3 monthsWithin 9 months
Buildings without an owners' corporationWithin 3 monthsGenerally an additional 3 months for preparation
Extension RequiredApply in writing to the Buildings Department or Independent Checking Unit with reasonable grounds

Who Can Act as a Qualified Person?

Qualified Persons are registered with the Building Authority and include Authorized Persons, Registered Structural Engineers, Registered Inspectors, Registered General Building Contractors and Registered Minor Works Contractors registered for the relevant window classes, types and items. The Qualified Person must personally carry out the prescribed inspection to determine whether windows are dangerous or liable to become dangerous. Where repair is needed, the owner must appoint a Registered General Building Contractor or Registered Minor Works Contractor to perform it under the Qualified Person's supervision.

SK Fung's Registered Minor Works Contractor number is MWC(W) 42/2014. We can coordinate inspection and installation. See our aluminium window and door services or contact us for details.

Consequences of Missing the Deadline

Non-compliance with a statutory notice under the Buildings Ordinance, Cap. 123
ItemDetails
Warning LetterThe Buildings Department generally issues a warning letter urging owners to arrange compliance
Fixed PenaltyA fixed penalty notice of HK$1,500 may be issued
Prosecution for Repeated Non-complianceUpon conviction: a fine of HK$25,000 and 3 months' imprisonment, plus HK$2,000 for each day the offence continues
Government-arranged WorkThe Buildings Department may appoint consultants and contractors for inspection and repair, recover the work and supervision costs from owners or the owners' corporation, and impose a surcharge not exceeding 20% of those costs
Unqualified InspectionA Qualified Person who fails to inspect personally may be fined HK$250,000; unqualified inspection may attract a HK$100,000 fine and 6 months' imprisonment

In late 2024, the Government proposed Buildings Ordinance amendments to the Legislative Council, including increasing the maximum fine for non-compliance with an MWIS notice from HK$25,000 to HK$100,000 and the fixed penalty from HK$1,500 to HK$3,000. These are legislative proposals; owners should refer to the Buildings Department's latest announcements.

Common Defects & Prescribed Repairs

  • Hinges: Rust, looseness, failed screws or replacement with unsuitable non-stainless-steel components are common defects.
  • Frame deformation or corrosion: Severe oxidation, cracked joints or separation from the wall.
  • Glass: Chipped edges, cracks, insecure fixing or missing glazing seals.
  • Failed hardware: Faulty latches, handles, locks or rollers that no longer secure the window properly.
  • Aged seals and silicone: Hardened or shrinking seals and cracked silicone causing leakage.

After inspection, we identify required repairs and explain their causes, distinguishing mandatory repairs from recommended improvements. Owners can then decide on hardware repair or window replacement.

Arrangements for Owners' Corporations & Buildings

Common-part windows in staircases, corridors, rooftops and lobbies are normally coordinated by the owners' corporation or management company, with a nine-month deadline. Preparation includes appointing a Qualified Person, approving the work and cost-sharing arrangement at an owners' meeting, and scheduling access floor by floor. SK Fung supports building-wide inspection, unit inspection records, repair quotations and Buildings Department submissions.

Statutory information is for reference. The requirements and deadlines in the statutory notice served by the Buildings Department or Housing Bureau's Independent Checking Unit take precedence for each case.

Aluminium Window Works

Window Replacement, Repairs & Waterproofing

From one sash to a whole-home replacement, leakage repair and hardware maintenance, the solution depends on window type, floor level and the cause of leakage.

Full-frame Replacement versus Retrofit Windows

MethodSuitable SituationFeatures
Full-frame Removal & ReplacementSeverely deformed or corroded frames, or leakage at the frame-to-wall jointAllows comprehensive waterproofing repairs; involves more dust, noise, time and plaster repairs
Retrofit ReplacementExisting frames and surrounding walls remain structurally soundA new frame is fitted over the old one, reducing disruption and time; joint detailing and a slightly smaller clear opening require attention
Single-sash ReplacementDamage to an individual sash, broken glass or sash deformationLowest cost, while retaining the existing frame and consistent appearance
Whole-home Window ReplacementRenovation, moving into a property or replacing old steel windows with aluminiumStandardises frame series, glass specifications and opening methods while addressing ageing windows together

Frame Series & Window Types

Aluminium frame series are commonly identified by product codes, such as the locally used “50 series”. Differences include profile thickness, cross-section design, supported glass thickness and wind-pressure performance. Sliding windows save space in corridors and kitchens; top-hung windows provide ventilation and rain protection in kitchens and bathrooms; casement windows offer a larger opening and good sealing; fixed windows provide daylight without ventilation. Louvres, window grilles and sills can also be coordinated.

Glass Specifications

  • Toughened glass: Higher strength and granular fragmentation when broken; commonly used for shower screens, glass doors and balustrades.
  • Laminated glass: An interlayer retains broken fragments, making it suitable for elevated locations and protective barriers.
  • Insulating double glazing: An air space between two panes improves thermal insulation and reduces condensation.
  • Acoustic glass: Helps address noise near busy streets, major roads or flight paths.
  • Low-E glass: A coating reflects infrared radiation; useful for west-facing rooms and large glazed areas.
  • Frosted glass: Admits daylight while providing privacy, commonly used in bathrooms and partitions.

Window Repairs: Hardware, Seals & Waterproofing

Many leaks can be addressed through targeted repairs. Common work includes hinge replacement, preferably using stainless steel, latch replacement, handles and locks, rollers, weather seals, silicone resealing, clearing drainage holes and glass replacement. Wind noise, sticking sashes, stiffness and slight deformation often result from worn rollers, dirty tracks or loose hardware and can improve through adjustment or component replacement.

Finding the Source of Leakage

  1. Check silicone at frame-to-wall joints for cracking or detachment.
  2. Check weather seals for hardening, shrinkage or displacement.
  3. Check whether blocked drainage holes cause water to build up and flow indoors.
  4. Check sash-to-frame fit and whether the hardware locks fully.
  5. Check external wall plaster and sills for cracks admitting water.

Identifying the cause before repair helps avoid continued leakage after sealing work. If exposed or high-level positions require scaffolding or a suspended working platform, the quotation explains safety measures and coordination with building management.

Glass Works

Rooftop Glass Houses, Partitions & Balustrades

Glass and aluminium systems can be used in homes, offices, shops and rooftop spaces.

Rooftop Glass Houses & Canopies

Rooftop construction involves ownership, the deed of mutual covenant, structural loading and the Buildings Ordinance. The permitted scope must be confirmed first. Design covers glass, aluminium structure, waterproofing joints, drainage falls and ventilation to address summer heat and rainwater backflow. See Glass Houses & Cabins.

Interior & Office Glass Partitions

Glass partitions divide space while retaining daylight. Offices can select laminated or double glazing for meeting-room acoustic needs and add sliding glass doors. See Glass Partitions.

Glass Balustrades & Handrails

Glass barriers on balconies, staircases and rooftops retain open views. Toughened or laminated glass is commonly fitted with stainless-steel clamps or aluminium base channels; fixing arrangements and height requirements need attention. See Glass Balustrades.

Glass Doors & Shopfronts

Frameless, automatic and shopfront glass doors provide a transparent frontage. Door fittings, floor springs, locks and glass replacement can be coordinated. See Glass & Fire-rated Doors.

Hotel-style Shower Screens

Custom shower glazing requires water retention, drainage and hinge detailing. Many leaks can be repaired by replacing seals, resealing silicone and adjusting hinges. See Shower Screens.

Mirror Works

Mirror walls create a sense of space in entrances, corridors, gyms and dance studios. Options include polished edges, low-iron mirrors and anti-fog treatments with suitable secure fixing. See Mirror Works.

Fire Doors · Insect Screens · Safety Nets

Fire-rated Doors & Window Safety Accessories

Fire-rated & Smoke-stop Doors

Fire doors generally require a recognised Fire Resistance Rating label, a complete frame and hardware assembly, and a self-closing device. They must remain closed and must not be held open with objects or hooks. When a Fire Services Department or Buildings Department direction, order or inspection requires replacement, select a compliant door and retain product certification and installation records. Industrial buildings, offices and food premises are common applications. See Glass & Fire-rated Doors.

Choosing Insect Screens

  • Concealed screens: Almost invisible when retracted, for rooms where appearance matters.
  • Roller screens: Convenient opening and closing with straightforward cleaning.
  • Pleated screens: Suitable for large windows, full-height glazing and sliding doors.
  • Fine-mesh screens: Balance insect protection and ventilation.

Fall-prevention Screens, Baby Safety Nets & Cat Nets

Safety nets aim to prevent children, pets or objects from falling, using stronger materials and fixings than ordinary insect screens. Installation must preserve normal window operation and emergency escape, and allow access to hinges and hardware for future mandatory window inspection. See Insect & Safety Screens.

Frequently Asked Questions

Window Inspection, Aluminium Windows & Glass Works FAQ

These twenty questions cover common enquiries from owners, owners' corporations and businesses.

What is the Mandatory Window Inspection Scheme?

MWIS and MBIS were fully implemented on 30 June 2012. Owners of private buildings aged ten years or more, excluding domestic buildings not exceeding three storeys, who receive statutory notices must appoint a Qualified Person to inspect all windows and supervise any prescribed repairs considered necessary.

How long do I have after receiving a statutory notice?

From the notice date, owners must appoint a Qualified Person within three months and complete inspection and required repair within six months. Common-part windows have a nine-month deadline. Buildings without an owners' corporation are generally given an additional three months for preparation.

Is a pre-notification letter a statutory notice?

No. It provides advance notice for preparation. The statutory notice is generally issued one to two months later, and legal obligations arise after it is served. Owners can use the earlier letter to compare quotations and arrange meetings.

Who qualifies as a Qualified Person?

Authorized Persons, Registered Structural Engineers, Registered Inspectors, Registered General Building Contractors and Registered Minor Works Contractors registered for the relevant window classes, types and items. The Qualified Person must inspect personally. SK Fung is a Buildings Department Registered Minor Works Contractor, No. MWC(W) 42/2014.

What happens if I do not comply with the statutory notice?

The Buildings Department generally sends a warning letter before issuing a HK$1,500 fixed penalty notice. Repeated non-compliance may lead to prosecution: upon conviction, HK$25,000 and three months' imprisonment, plus HK$2,000 for each continuing day. Government-arranged work may also be charged to owners, with a surcharge not exceeding 20%.

How does window inspection differ from building inspection?

MWIS concerns all windows and requires personal inspection by a Qualified Person for private buildings aged ten years or more. MBIS concerns the structure, external walls and common facilities, has a higher age threshold and requires a Registered Inspector. MBIS non-compliance upon conviction may attract HK$50,000 and one year's imprisonment.

Can obstructed windows be exempted from inspection?

No. Decoration or furniture obstructing windows is not a reason for exemption under MWIS. Remove obstructions beforehand so the Qualified Person can inspect all windows and hardware.

Who submits the inspection and repair records?

The Qualified Person submits the inspection and repair reports using the Buildings Department's specified forms. After SK Fung's inspection and repair, we handle the submission and the owner retains the documents for reference.

How are inspection and window works priced?

Pricing depends on the number, type and size of windows, frame series, glass, replacement hardware, floor level and access method—indoors, scaffolding or suspended platform. Our free measurement and design quotation lists the items for approval before work begins.

Must the existing frame always be removed?

No. Retrofit replacement can reduce time, dust and noise where the existing frame and surrounding walls are sound. Severely deformed or corroded frames, or leakage at frame-to-wall joints, may require full-frame replacement.

What commonly causes window leakage?

Aged silicone at frame-to-wall joints, hardened seals, blocked drains, poor sash-to-frame fit, loose hinges or external wall cracks. Diagnose the cause before deciding on sealing, seal replacement, hardware adjustment or frame reconstruction.

Can hardware be replaced individually?

Yes. Hinges, latches, handles, locks, rollers and seals can be replaced separately. Corroded or loose hinges and aged seals are common MWIS defects and often require component repair rather than full replacement. Stainless-steel hinges are recommended for durability.

What glass options are available?

Toughened, laminated, insulating double glazing, acoustic, Low-E and frosted glass. Shower screens, doors and barriers commonly use toughened or laminated glass; noisy street-facing properties may benefit from acoustic or double glazing, and west-facing rooms from Low-E glass.

What can be done about wind noise or sticking windows?

Wind noise often comes from aged seals or gaps and may improve with new seals and hardware adjustment. Sticking or stiff sashes can result from worn rollers, dirty tracks or deformed hinges; cleaning and component replacement may resolve them.

What should I consider for a rooftop glass house?

Ownership, the deed of mutual covenant, structural loading and the Buildings Ordinance must be checked before confirming permitted construction. Design covers glazing, aluminium structure, waterproofing, drainage falls and ventilation. A site visit is recommended before design and quotation.

What are the requirements for fire doors?

Generally a recognised FRR label, complete frame and hardware, and a self-closing device. Doors must remain closed and unobstructed. Follow any Fire Services Department or Buildings Department direction or order, and retain product certification and installation records.

Should a leaking shower screen be repaired or replaced?

If the glass is sound, replacing bottom seals, resealing silicone and adjusting hinges or rollers may resolve leakage. Chipped glass, corroded or deformed hinges, or an inadequate water-retaining design may call for a new custom shower screen.

How do insect screens differ from safety nets?

Insect screens prioritise insect protection, ventilation and daylight. Fall-prevention screens, baby safety nets and cat nets use stronger materials and fixing arrangements. Both must preserve window operation and future inspection access.

How are windows replaced in high-rise units?

Many residential jobs can be carried out indoors with safety harnesses and temporary enclosure at exposed edges. Large, exposed or full-frame replacements may need scaffolding or suspended access, coordinated with management. The quotation explains the arrangements.

How should an owners' corporation arrange common-part inspection?

The corporation or management company coordinates inspection and completion within nine months of the statutory notice. This includes appointing a Qualified Person, approving work and cost sharing at an owners' meeting, and arranging floor-by-floor access. SK Fung supports inspections, unit records, repair quotations and submissions.
